PUBLIC OFFER

for website and server monitoring services

1. General Provisions

1.1. This Public Offer (hereinafter referred to as the “Offer”) is an official offer by individual entrepreneur Полищук Дмитрий Михайлович, Russian Taxpayer Identification Number (INN) 502716005180, hereinafter referred to as the “Contractor”, to enter into an agreement for the provision of website and server monitoring services with any legally capable individual or legal entity (hereinafter referred to as the “Customer”).

1.2. Payment by the Customer for the selected plan shall be deemed acceptance of the terms of this Offer.

2. Subject Matter of the Offer

2.1. The Contractor provides technical monitoring services, including:

  • Checking website availability to visitors;
  • Checking server availability by IP address or domain name;
  • Checking the domain name registration expiry date;
  • Checking the operation of services on specified ports (for example, HTTP, HTTPS, SMTP, etc.);
  • Checking the expiry date of the domain’s SSL certificate;
  • Checking whether the server’s IP address is listed in spam blacklists (RBLs);
  • Checking the correctness and integrity of the domain’s DNS records;
  • Checking server processor (CPU) utilization;
  • Checking server memory usage;
  • Checking server disk space utilization;

2.2. The services are provided using software hosted at https://upchecker.tech, with the option to manage checks independently through the personal account.

3. Payment Procedure

3.1. Current plans and service descriptions are published on the UpChecker website.

3.2. Payment is made on a cashless basis through the payment systems available on the website.

3.3. Payment by the Customer for the selected plan constitutes acceptance of this Offer and confirms that the agreement has been entered into.

4. Terms of Service Provision

4.1. Services are activated automatically or manually within 24 hours of receipt of payment.

4.2. Notifications of monitoring results may be sent to the Customer by email, Telegram, or other channels, depending on the selected settings.

4.3. The Contractor shall not be liable for disruptions in third-party services, hosting providers, or DNS providers, or for incorrect data provided by the Customer.

5. Rights and Obligations of the Parties

5.1. The Contractor shall provide the services properly, in a timely manner, and in accordance with the selected plan.

5.2. The Customer shall use the services solely in accordance with applicable law and shall not provide third parties with access to the personal account.

5.3. The service may not be used to monitor resources that violate the laws of the Russian Federation or other countries.

6. Refunds

6.1. Payment may be refunded only if the service cannot be provided due to the fault of the Contractor and provided that the issue is not resolved within 3 business days.

6.2. Refunds are issued upon the Customer’s written request sent to the email address specified in Section 8.

7. Miscellaneous

7.1. The Contractor may amend the terms of the Offer and the plans by publishing the current version on the website.

7.2. All disputes and disagreements shall be resolved through negotiation; if no agreement is reached, they shall be resolved in accordance with the laws of the Russian Federation.
